Terms of Service

These Terms of Service ("Terms") govern your access to and use of the CallSec secure communication platform, including the website at callsec.si and the CallSec mobile applications (collectively, the "Service"). By using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.
2. Description of Service
CallSec provides a secure, end-to-end encrypted communication platform that includes:
- Encrypted text messaging (one-to-one and group conversations)
- Encrypted voice and video calling
- Secure file sharing within conversations
- Multi-device session management
- On-device security features (threat detection, biometric lock, etc.)
3. Eligibility
You must be at least 16 years of age to use the Service. By using CallSec, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
4. Account Registration
- Accounts are created through an invitation or registration process managed by your organization's administrator
- You are responsible for maintaining the confidentiality of your account credentials, PIN, and authentication methods
- You must immediately notify your administrator of any unauthorized use of your account
- You are responsible for all activities that occur under your account
5. Acceptable Use
You agree to use the Service only for lawful purposes. You must not:
- Use the Service to transmit illegal, harmful, threatening, abusive, or otherwise objectionable content
- Attempt to gain unauthorized access to other users' accounts or data
- Interfere with or disrupt the Service, servers, or networks
- Reverse engineer, decompile, or disassemble any part of the Service
- Use the Service to distribute malware, viruses, or other harmful software
- Circumvent or disable any security features of the Service
- Use the Service for mass unsolicited communications (spam)
- Impersonate another person or entity
- Use the Service in violation of any applicable local, national, or international law
6. End-to-End Encryption
CallSec provides end-to-end encryption for messages and calls. This means that CallSec cannot access, read, or decrypt the content of your communications. You acknowledge that:
- You are solely responsible for the content of your communications
- If you lose your encryption keys (e.g., by uninstalling the app without backup), previously encrypted messages may become unrecoverable
- CallSec cannot recover encrypted content on your behalf
7. Device Security
The CallSec application includes security features designed to protect your device and communications. By using the Service, you acknowledge that:
- The app may detect and alert you to potential security threats on your device (root access, screen recording, etc.)
- Certain features may be restricted on devices that fail security checks
- You are responsible for maintaining the physical security of your devices
8. Intellectual Property
- The Service, including its software, design, logos, and documentation, is the intellectual property of CallSec and is protected by applicable copyright and trademark laws
- You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose
- You may not copy, modify, distribute, sell, or lease any part of the Service without prior written consent
9. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. Key points include:
- Message content is end-to-end encrypted and inaccessible to CallSec
- We collect only the minimum data necessary to operate the Service
- We do not sell your data to third parties
- Data is stored on servers in Europe in compliance with GDPR
10. Service Availability
- We strive to maintain high availability but do not guarantee uninterrupted access to the Service
- The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control
- We reserve the right to modify, suspend, or discontinue the Service (or any part of it) with reasonable notice
11. Account Termination
- You may request deletion of your account at any time by contacting info@callsec.si
- We may suspend or terminate your account if you violate these Terms
- Your organization's administrator may manage your account in accordance with their enterprise agreement
- Upon termination, your right to use the Service ceases immediately. Encrypted data on your devices remains under your control
12. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. While we implement robust security measures, no system is completely immune to all threats, and we do not warrant that the Service will be entirely free from vulnerabilities.
13. Limitation of Liability
To the maximum extent permitted by applicable law:
- CallSec shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
- CallSec shall not be liable for any loss of data, loss of profits, or business interruption
- Our total liability for any claim arising from the Service shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim
14. Indemnification
You agree to indemnify and hold harmless CallSec, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
15. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms. For material changes, we will make reasonable efforts to notify you through the Service or via email.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the European Union and the applicable national laws of the jurisdiction in which CallSec operates. Any disputes arising from these Terms shall be resolved through the competent courts of that jurisdiction.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
18. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and CallSec regarding the use of the Service and supersede any prior agreements or understandings.
